User Agreement

Version: 2026-11-02 Effective date: November 2, 2026

This User Agreement (“Agreement”) is between you and FableForge LLC, a Massachusetts limited liability company (“FableForge,” “we,” “us,” or “our”). It covers your use of FableArtist at fableartist.com, app.fableartist.com, and the hosted creative tools we make available through those websites (the “Service”).

Please read this Agreement before accepting it. By selecting the acceptance checkbox and clicking “Agree and continue,” you agree to these terms. Creating an account by itself does not constitute acceptance of this Agreement. If you do not agree, do not accept or use the creative tools or purchase credits. You may contact us to request account closure.

If you accept on behalf of a business or another organization, you represent that you have authority to bind it. “You” then includes that organization and the person using its account.

1. Eligibility and account security

You must be at least 18 years old, meet any higher minimum age required to enter a binding contract where you live, and be legally permitted to use the Service. The Service is not intended for children.

Provide accurate account information, keep your credentials secure, and promptly report suspected unauthorized access to support@fableartist.com. You are responsible for the people you authorize to use your account and the work you authorize them to submit. Responsibility for unauthorized activity will be determined under applicable law and the facts; it is not automatically assigned to you merely because your account was used.

Do not share, sell, rent, or transfer accounts without our permission, create accounts to evade restrictions, or misrepresent your identity or authority. Registration does not guarantee immediate access during an invitation-only or limited release.

2. What FableArtist provides

FableArtist helps users develop stories and create or edit text, characters, images, comics, audio, video, and related creative material using software and third-party AI services. Available models, features, generation times, output formats, and technical limits may change.

AI output can be inaccurate, inconsistent, incomplete, offensive, or similar to material generated for other people. We do not guarantee a particular creative result, successful generation on every attempt, originality, exclusive ownership, legal clearance, or eligibility for copyright protection.

Unexpected prohibited output. AI systems and automated safety measures can fail. A third-party model may produce sexually explicit, exploitative, or otherwise prohibited material even when a user submits a permitted request. The existence of such output, or a provider’s failure to block it, does not mean that FableForge requested, approved, endorsed, or authorized it. No model, filter, provider approval, or safety setting is a guarantee that output is lawful or permitted under this Agreement. These statements do not excuse our own unlawful conduct or remove our duties under applicable law. Section 5 explains what to do if prohibited output appears.

You must review output before publishing, selling, sharing, or relying on it. FableArtist is a creative tool, not a substitute for professional legal, medical, financial, or other regulated advice.

3. Your inputs and permissions

“Inputs” include material you upload, import, link, paste, record, or submit, including stories, prompts, reference images, voices, music, video, and personal information.

You retain your rights in your Inputs. You represent that you have the rights, permissions, consents, and lawful basis needed to submit them and authorize their processing for your requested work. Importing a publicly accessible URL does not give you permission to copy, adapt, publish, or sell its contents. Do not use the Service to bypass paywalls, access restrictions, or other technical protections.

Before using an identifiable person’s image, likeness, or voice, obtain any consent and rights required for the proposed use. This applies to people depicted in reference material and people represented in generated media. Do not upload confidential information or sensitive personal information unless you are authorized to do so and the intended processing is appropriate.

You give us a nonexclusive, limited license to host, copy, transmit, process, adapt, and display your Inputs and resulting project material as reasonably necessary to provide the features you request, deliver results, maintain and secure the Service, resolve support issues, and meet legal obligations. This includes processing by our service providers for those purposes. It does not give us ownership of your work or permission to use private projects in public advertising.

This license ends when the material is deleted from the Service, except to the limited extent necessary for backup expiration, resolving existing disputes, preventing abuse, or meeting legal retention obligations, as described in the Privacy Notice. Material you have independently shared with others may remain with them.

4. Generated output and commercial use

“Output” is material generated for you through the Service. As between you and FableForge, and to the extent permitted by law and the applicable model license, you retain any rights you already hold in Output, and we assign to you any transferable rights we may hold in Output created for your account. This does not transfer ownership of the Service, third-party models, software, trademarks, or another person’s material.

You may use your projects and Output commercially if you have the necessary rights and comply with this Agreement, applicable law, and any model-specific commercial restrictions clearly identified before you use that model. We do not grant rights that neither you nor we possess. You are responsible for checking copyright, trademark, publicity, music, voice, and other permissions relevant to your use.

Any assignment or permission in this section is subject to Section 5. It does not authorize possession, access, use, reproduction, or distribution of prohibited material where unlawful, or authorize any use of prohibited material contrary to this Agreement. Payment for generation does not create an exception.

AI Output may not be unique or protectable by copyright. Another user may receive similar material. We do not promise exclusivity or that Output is free of third-party claims. Disclose synthetic or AI-generated content when required by law or the platform where you publish it.

5. Acceptable use

You may not use the Service to create, upload, request, distribute, or facilitate:

You also may not:

Report suspected security vulnerabilities privately to support@fableartist.com. Do not access other users’ information, run disruptive tests, or incur charges without authorization. This Agreement is not authorization to conduct security testing.

We may refuse, restrict, or remove content or requests to enforce these terms or meet legal and provider obligations. Technical availability of a feature does not mean every use is permitted. Nothing in this Agreement restricts honest reviews, lawful complaints, protected reporting, or cooperation with regulators.

If unexpected prohibited output appears. Stop interacting with the affected result. Do not continue the sequence, request variations of it, use it as a reference, or attempt to reproduce or improve the prohibited features. Do not publish, share, sell, or distribute it. Promptly notify support@fableartist.com using your account email, a project or request identifier, the approximate time, and a brief non-graphic description. Do not attach, email, re-upload, screenshot, or download suspected CSAM or other unlawful imagery to make a report, and do not create or keep additional copies. We may request non-content identifiers through a secure process. You may also make lawful reports directly to the appropriate authorities; reporting to us does not replace any legal duty you may have.

You must not knowingly request prohibited output, deliberately circumvent safeguards, or knowingly continue a prohibited use after an unexpected result. A provider’s willingness to process a request does not override these restrictions. An inadvertent result from a permitted request, without more, is not by itself a finding that you intentionally violated this Agreement. We may still restrict the affected content or activity while reviewing it. A good-faith report does not itself trigger a penalty or establish wrongdoing, although reporting does not excuse intentional misconduct.

Safety response and legal compliance. Subject to applicable law, we may block or quarantine a result; prevent its display, download, export, further processing, or sharing; disable an affected feature or model; restrict account activity; and investigate apparent abuse. Where legally permitted or required, we may review relevant Inputs, Output, and associated account or request records through an appropriately restricted process, preserve relevant evidence securely, and report or disclose information to the National Center for Missing & Exploited Children (“NCMEC”), law enforcement, or other competent authorities. We will comply with applicable reporting, preservation, privacy, removal, and disclosure obligations. A report to an AI provider does not replace any reporting duty that independently applies to us.

We do not promise immediate deletion of suspected unlawful material or associated evidence where preservation or other legal obligations apply. Restricted evidence must not remain available through ordinary project access, exports, or sharing. Legal reporting and preservation may occur without advance notice to the account holder where notice is prohibited or would prejudice a lawful investigation. Nothing in this Agreement permits unlawful retention or disclosure, requires a user to investigate suspected CSAM, or waives any person’s nonwaivable legal rights.

6. Third-party AI and other providers

The Service depends on third-party AI models, payment processing, authentication, hosting, and storage. Your requests and relevant project material may be transmitted to providers needed to fulfill the features you choose. Their processing and retention practices are described or linked in our Privacy Notice.

A model may impose additional use or licensing restrictions. We will identify applicable model-specific restrictions before its use. Provider outages, refusals, rate limits, model changes, or discontinuations can affect a request. Our obligations to you under this Agreement and mandatory law are not removed merely because a provider is involved.

Third-party providers, including fal.ai where used, develop or operate models and safety systems that FableForge does not fully control. We do not warrant that their moderation, age assessment, or content classification will identify every prohibited request or result. Provider processing, an unflagged result, or a payment confirmation is not our approval or a representation that the result passed an independent human review. We may stop offering a provider or model when necessary for safety or legal compliance.

To the extent permitted by law and subject to Sections 13 and 14, we disclaim warranties that third-party models or safeguards will prevent all prohibited content, and our contractual liability for their errors or failures is subject to the limitations in Section 14. This does not release us from our own express commitments, applicable statutory duties, or liability that cannot lawfully be excluded. It does not establish that an AI provider must indemnify either you or us; any such obligation depends on a separate enforceable agreement with that provider.

This Agreement does not authorize us to use your private projects to train our own general-purpose AI models. Any such use requires separate notice and permission. This statement does not make a promise about third-party model training or retention; see the Privacy Notice before you submit material.

7. Purchased credits and payments

FableArtist currently uses prepaid credits purchased through one-time payments, not a recurring subscription. Purchasing credits does not authorize automatic replenishment, recurring charges, or future purchases. Any future subscription or automatic replenishment feature will require separate, clear authorization.

Prices and balances are stated in U.S. dollars unless expressly identified otherwise. Each US$1 paid for credits adds US$1 of purchased credit balance. Taxes or other separately disclosed charges, if applicable, are shown before payment and do not add credit balance unless expressly stated.

Credits are a prepayment for eligible FableArtist services, not a bank account, deposit, investment, or means of sending money to other people. Credits do not earn interest and are not transferable or resalable. Except under the refund provisions below or where required by law, credits cannot be exchanged for cash.

Purchased credits do not expire and have no inactivity fees. If we permanently discontinue the paid Service, we will provide a process to refund unused purchased credits, subject to applicable law and resolution of genuine payment disputes. Promotional credits are provided without payment, are not redeemable for cash, and may have separate limits or an expiration disclosed when offered. Such limits do not reduce your purchased credits.

Payment details are collected through our payment processor. You authorize the specific purchase you confirm and must use a payment method you are entitled to use. Credits become available after payment is confirmed; payment review or asynchronous payment processing may delay availability.

8. Usage charges, reservations, and cancellations

Our current AI usage charge is twice the actual third-party AI provider cost attributable to your request, measured in U.S. dollars. For example, a US$0.10 provider cost results in a US$0.20 usage charge. Different models and settings can have different costs. Fractional-cent charges may be recorded internally even if the displayed balance is rounded to two decimal places.

The applicable pricing basis and any additional service charges must be disclosed before you authorize paid work. Estimates are not a fixed-price quote unless specifically labeled as one. A batch or multi-step workflow may submit multiple billable requests. Authorizing that workflow authorizes the disclosed steps within the scope and limits shown to you; it does not authorize unrelated work or unlimited spending.

We may reserve part of your balance before submitting work. A reservation is a temporary hold, not a final charge. Once provider cost is confirmed, we settle the actual authorized charge and release any unused reservation. Reconciliation delays can temporarily affect your available balance. We will not charge the same provider request twice or charge you for unrelated requests or other accounts’ work.

If you cancel after a request has been submitted, cancellation may not stop processing immediately or eliminate provider costs already incurred. A request that fails, is refused, or returns an unsatisfactory result may still incur provider costs. Any charge must reflect the disclosed pricing basis and attributable provider costs; this does not exclude corrections, remedies for service defects, or refunds required by law. A request not submitted to a provider should not incur an AI generation charge.

Safety blocking or quarantine does not authorize access to prohibited content in exchange for payment. If prohibited output is unexpectedly produced from an otherwise permitted request, we will review any associated charge under Section 9 and applicable law; we do not make every such request automatically non-refundable merely because a provider charged us. Good-faith safety reporting does not trigger an additional fee.

Each additional generation or regeneration you authorize is a new request and can incur a new charge. We may pause work when funds are insufficient. We do not automatically charge your payment method to cover additional usage without separate authorization.

We may change prices for future work after clear advance disclosure. Changes do not retroactively alter the pricing basis for work already authorized. Contact billing@fableartist.com if you believe a hold or charge is incorrect.

9. Refunds and billing disputes

You may request a refund of the unused portion of a purchased credit payment within 14 days after that payment. Email billing@fableartist.com from your account email address with the payment date or receipt reference. Do not send full card details.

The refund is limited to the unused purchased credits attributable to the eligible payment, after reconciling authorized usage and any outstanding holds. Used credits and promotional credits are generally not refundable under this voluntary policy. We will not treat a temporary hold as completed usage or withhold the whole balance solely because one charge is disputed. Approved refunds normally go to the original payment method; payment-provider processing times may apply.

If credits have been combined from several payments, we will apply a consistent, documented allocation of usage and refunds. Total refunds will not exceed the amount you paid for the eligible unused credits. Credits associated with a completed refund will be removed so that the same amount cannot be spent and refunded.

The 14-day limit does not restrict refunds, cash redemption, cancellation rights, corrections for duplicate or unauthorized charges, remedies for defective or undelivered services, or other rights required by applicable law. We will investigate billing errors and make appropriate corrections even if you report them after 14 days. Dissatisfaction with the artistic style of an otherwise properly delivered generation is not, by itself, a promise of a refund for provider costs already incurred.

You may contact us first to help resolve an issue, but doing so is not a condition of exercising lawful rights with your bank, payment provider, regulator, or a court. We do not impose a penalty merely for making a good-faith dispute.

If a payment is reversed, refunded, or disputed, we may temporarily restrict the corresponding credits or paid activity while we investigate, subject to applicable law. Any final adjustment will reflect the actual payment outcome and will not duplicate an earlier reversal. If a reversal affects credits already used, we will explain the account adjustment and available resolution; we will not charge your payment method again without authorization. We will not apply a blanket forfeiture of unrelated purchased credits.

10. Privacy, project access, and communications

Our Privacy Notice, available at /privacy and provided alongside this Agreement before acceptance, explains personal information processing, service providers, retention, account requests, and applicable privacy rights. This Agreement is not a substitute for that notice or a blanket consent to optional data uses.

Keep your own copies of important Inputs and Output. The Service is not an archival storage guarantee. Project availability can be affected by technical failures, lawful removals, your deletion requests, or account restrictions. Retention and deletion are described in the Privacy Notice and applicable product notices.

The recommendation to keep copies applies only to material you may lawfully possess and use. It does not apply to suspected CSAM or other unlawful content. Safety-related review, restricted evidence retention, and legally required reporting described in Section 5 remain subject to applicable law and the Privacy Notice; account closure or an ordinary deletion request may not require immediate destruction of evidence we are legally required to preserve.

We may send necessary service, security, account, and transaction messages. Optional marketing communications require any consent required by law and can be opted out of without losing access to ordinary account functions.

11. Our software and feedback

FableForge and its licensors retain rights in the Service’s software, interface, branding, and documentation. We give you a limited, nonexclusive, nontransferable right to access the Service for permitted purposes while you comply with this Agreement. No software ownership or broader intellectual property license is transferred.

You may voluntarily send suggestions. We may use those suggestions to improve the Service without payment or an obligation to adopt them. This does not give us ownership of your projects, waive your privacy rights, or transfer rights in your honest reviews.

12. Suspension and account closure

You may stop using the Service at any time and request account closure through support@fableartist.com. Closing your account does not itself waive eligible refund rights, erase a valid billing claim, or remove legal record-retention obligations.

We may restrict or suspend access where reasonably necessary to address a material violation, fraud, security risk, unlawful content, provider requirement, or legal obligation. Where feasible and lawful, we will explain the action and provide an opportunity to resolve it. Immediate restrictions may be needed to protect users or the Service. You may request review at support@fableartist.com.

We may end the Service or an account on reasonable notice, except where immediate action is justified. When practicable and lawful, we will give you a reasonable opportunity to export permitted project material. Account termination does not automatically forfeit unused purchased credits. We will address those credits under Section 9, applicable law, and any substantiated account adjustment. We will not retain unrelated purchased credits simply as a penalty.

13. Availability and warranties

Some features may be labeled alpha, beta, experimental, or preview. They may change, fail, or be unavailable. We do not promise uninterrupted access, a particular processing time, or that every model or project format will remain available forever.

To the extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This disclaimer does not override express commitments in this Agreement or rights and warranties that applicable law does not allow us to exclude.

Subject to those same limitations, we do not warrant that generated content or third-party safeguards will be error-free, age-appropriate, lawful, or compliant with every content policy in every instance. This is not a disclaimer of an obligation to respond as legally required when we become aware of apparent unlawful content, or permission to ignore known safety failures.

14. Limits on liability

To the extent permitted by law, neither party is liable to the other for indirect, incidental, special, or consequential losses arising from this Agreement, including lost profits or business opportunities, except where such a limitation is not legally permitted.

Subject to the exceptions below, FableForge’s total liability arising from the Service or this Agreement is limited to the greater of US$100 or the amounts you paid us during the 12 months before the event giving rise to the claim. Our obligations to refund eligible unused purchased credits and correct billing errors are separate from, and are not reduced by, this cap.

Nothing in this Agreement excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability or remedy that cannot lawfully be excluded or limited. It does not waive nonwaivable consumer rights, including applicable rights under Massachusetts General Laws Chapter 93A, or mandatory protections under the laws of your place of residence.

15. Third-party claims involving your material

To the extent permitted by law, you are responsible for third-party claims and reasonable resulting costs caused by your unlawful Inputs, your infringement of another person’s rights, or your intentional misuse of the Service. This does not make you responsible for claims caused by our unlawful conduct, negligence, changes to your material that you did not authorize, or our breach of this Agreement. It does not create liability for you merely because AI generated an unexpected result.

To the extent permitted by law, you agree to indemnify FableForge against third-party claims, judgments, and reasonable legal costs to the extent caused by your knowing submission of prohibited sexual or exploitative material, deliberate evasion of safeguards, or knowing unlawful distribution or continued prohibited use of Output. This obligation applies only to your attributable misconduct; it does not shift liability for an unexpected result from a permitted request merely because you encountered or reported it. It does not cover losses caused by our negligence, our unlawful conduct, or a provider failure for which you are not legally responsible, or override mandatory consumer protections. Notice, participation, cooperation, and settlement protections in the following paragraph apply to this obligation.

If we seek reimbursement for such a claim, we must promptly notify you, provide reasonable cooperation, and give you a meaningful opportunity to participate in the defense. We will not agree to a settlement that imposes obligations on you without your reasonable consent. This section does not impose an obligation that consumer law prohibits.

16. Governing law and resolving concerns

Massachusetts law governs this Agreement, without using its conflict-of-law rules to select another jurisdiction’s law, except that mandatory protections of your place of residence continue to apply.

Please send service concerns to support@fableartist.com and billing concerns to billing@fableartist.com. We will try to resolve them in good faith. Contacting us is not a mandatory prerequisite to legal remedies, and it does not shorten or suspend legal deadlines unless the law or a written agreement provides otherwise.

Unless applicable law requires another forum, disputes may be brought in the state or federal courts located in Massachusetts that have jurisdiction over the dispute. Any mandatory right to bring a consumer claim in your local courts is preserved.

This Agreement does not require arbitration or waive class-action rights. It does not restrict complaints to regulators or access to small-claims courts where available.

17. Changes and general terms

We will identify each version of this Agreement and provide notice of material changes. We will ask you to affirmatively accept a materially revised agreement before further paid work or purchases under that version. Changes apply prospectively, subject to applicable law. Refusing a revision does not eliminate accrued rights or eligible refunds.

This Agreement, together with any specifically agreed written order and model restrictions disclosed before use, describes the terms for the Service. A separate agreement signed by us and you controls an actual conflict within its scope. The Privacy Notice describes data handling and does not override the promises or mandatory rights in this Agreement.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted. A failure to enforce a provision once is not a permanent waiver. You may not assign this Agreement without our consent, except where law permits. We may transfer it with a genuine merger, restructuring, or transfer of the Service, subject to applicable law, notice, and preservation of your accrued rights.

Provisions that reasonably need to continue after closure, including accrued billing obligations, eligible refunds, intellectual property, legal retention, and dispute terms, continue only for that purpose.
